Despite Suspension and Jail Time, Teacher Burke Retains Government Salary

Dublin: Secondary school teacher Enoch Burke finds himself in Mountjoy Prison, yet remains on full government pay, following his incarceration for defying a suspension order and attending classes. The High Court intervened, emphasising that the government is shouldering the financial burden of his imprisonment by maintaining his salary.

Burke’s legal troubles stemmed from his stance that transgender individuals should only be recognized based on their biological gender. Despite a court order prohibiting him from entering Wilson’s Hospital School in Westmeath, the school management failed to enforce this directive, leading to Burke’s imprisonment several months ago. Additionally, Burke’s family members—his mother Martina, father Cian, sister Ammi, and brother Isaac—were barred from the courtroom due to disruptive behavior during recent proceedings.

Justice Mark Sanfe criticised the situation, questioning the appropriateness of incarcerating Burke while he continues to receive full pay. The court highlighted Burke’s failure to address court costs or fines, ultimately remanding him. A further hearing is scheduled for March 22, with Burke’s appeal against his dismissal from the school pending.

The court underscored the necessity of compliance with its orders, prompting demands for assurances from Burke, which he did not provide. Last year, Burke was fined 23,800 euros for contempt of court, with the school instructed to seize his assets, a directive that remains unfulfilled.

In court, Burke vehemently defended his beliefs, asserting his refusal to accept transgenderism and rejecting proposals from the school’s former principal, Niamh McShane. He maintained his right to hold any viewpoint, condemning the court’s actions as mockery and accusing them of advocating wrongdoing. Despite the legal proceedings, Burke sees himself as a proponent of truth, steadfast in his convictions amidst the ongoing judicial scrutiny.
