Dublin: Divya Jayarajan, formerly the director of nursing at The Four Ferns Nursing Home in Foxrock, Dublin, contested her dismissal in court, asserting that she was unfairly targeted for deficiencies uncovered during a nursing home inspection. Her legal action was directed against Integrated Elder Care Group, an organisation operating numerous nursing homes across Ireland. Divya lodged her complaint at the close of the previous year, seeking redress that included reinstatement and compensation. The nursing home operator refuted all of Divya’s allegations.
The case was scheduled for a hearing yesterday, yet both parties informed the court that they had reached a mutually acceptable resolution. Consequently, the High Court dismissed all proceedings related to the matter, with the terms of the settlement undisclosed.
Last September, an inspection conducted at HIQA Nursing Home raised concerns ranging from management practices, resident rights, fire safety protocols, to care standards. The company attributed these issues to Divya’s oversight, leading to her dismissal. However, Divya argued in court that these matters fell beyond her scope of responsibility, asserting that the dismissal was unjust.
Additionally, Divya raised concerns about racist remarks made by another staff member, alleging that management disregarded her complaints on this matter. She further contended that the unfair treatment had detrimental effects on her health and professional standing.
Divya’s employment was within a 144-bed nursing home, and she resides in Newbridge, Kildare.
