Dublin: The High Court has upheld the Nursing and Midwifery Board of Ireland’s (NMBI) action to issue a warning after a nurse was found guilty of smuggling drugs for own use.
The board determined that the nurse violated the model code of conduct by acting in an unprofessional manner. However, the board also decided to take a compassionate approach to this nurse, who is undergoing treatment.
Given the personal circumstances, the board decided to waive the 1,000 euro fine imposed by the Fitness to Practise Committee. These steps were supported by the President of the High Court, Justice David Barniville.
Took the drugs from the hospital storage cabinet on four dates in May 2018. The nurse admitted the theft in court.
Following a complaint from the hospital’s director of nursing, the board launched an investigation. And was ordered to abstain from all non-prescription drugs for two years and to see a physician once every three months.
It was a relief to the nurse, that NMBI decided to take punitive action with a written warning despite not following the code of professional conduct. All the investigating teams and the court had directed that the name of the nurse should not be disclosed.
