The Supreme Court disposed of a number of petitions filed by repatriated Indian medical students from Ukraine, China, the Philippines, etc. on Tuesday, after the central government informed the court that, as a one-time extraordinary measure, penultimate year students would be allowed to take the MBBS examination without being enrolled in any Indian medical college.
The Court allowed such students to clear the MBBS final exams in two attempts, modifying the Centre’s suggestion of allowing them one attempt.
A division bench of Justices BR Gavai and Vikram Nath was hearing the cases of medical students who were unable to complete their studies abroad due to intervening circumstances such as COVID-19 travel restrictions in China or the Philippines or the outbreak of hostilities between Russia and Ukraine. Their common request was to be accommodated as an exceptional humanitarian action in the Indian medical education architecture. The bench had previously encouraged the union government, in collaboration with the National Medical Commission, to find a solution to this “human dilemma.” To investigate this matter, an expert committee was formed.
On Tuesday, Aishwarya Bhati, Additional Solicitor-General for India, informed the bench that, in response to this appeal, the government had constituted a committee to accommodate medical graduates in their penultimate year who were forced to return from Ukraine or China and continue their education remotely.
