Dublin: A court has ordered Ryanair to pay €55,000 in compensation to Lidija Miliut, a Lithuanian national, who suffered second-degree burns after a hot teapot accidentally spilled on her during a flight. The compensation covers burns sustained on her stomach, thighs, and wrists following the incident.
Judge James O’Donoghue, presiding over the case at the Circuit Civil Court, stated that the substantial amount of damages was awarded after careful consideration of the extent of Miliut’s injuries and the impact on her well-being. The judge, however, has stayed the order pending an appeal to the High Court.
Details of the Incident
The incident occurred on March 28, 2022, during a Ryanair flight from Palenque Airport to Dublin. Miliut, 26, who was residing in Wexford at the time, was returning from Lithuania when the accident happened.
According to court testimony, the hot teapot slipped from a tilted tray table while tea was being served, spilling scalding liquid onto Miliut. Cabin crew members, along with a nurse who was onboard, administered first aid immediately after the incident. Upon arrival in Dublin, Miliut sought medical attention from her general practitioner but had to undergo further treatment at St. Vincent’s University Hospital a few days later.
Court Proceedings and Testimonies
During the trial, Miliut described enduring severe pain for two hours on the flight following the burn injuries. She provided detailed accounts of her suffering, supported by testimonies from fellow passengers and crew members who witnessed the incident.
A Ryanair Technical Services engineer testified, stating that the airline conducts regular maintenance and safety checks on aircraft cabins, including tray tables. However, the court found no evidence of negligence on Miliut’s part.
Judge O’Donoghue noted in his ruling: “Ms. Miliut demonstrated herself to be a responsible and conscientious individual. The incident was serious, and the pain and distress she endured were significant.”
The judge emphasised the severity of the injuries, particularly given the sensitive areas affected, which contributed to the decision to award substantial compensation.
