European court orders Swiss to end the unfair discrimination against men

Geneva: According to the European Court of Human Rights, Switzerland discriminates against men unfairly. The court stated that men are underserved by government assistance. Following the judgment, the administration has begun to debate whether more support should be offered to men or women.

The decisive court verdict came on the plea of Max Beeler that the government assistance was stopped because the children had reached the age of majority. According to the country’s law, males lose their claim to a pension when their children reach the age of 18. This restriction, however, does not apply to women. The petitioner claims that the discrimination is unfair. The European Court of Justice has stated that this is correct. The ECHR judgment also applies to Switzerland, a member of the European Council. Therefore, the government may be forced to legislate in this regard.

After his wife Maria perished in an accident in 1994, Beeler had to stop his career to take care of his two four-year-old children. However, after the children attained the age of majority, the government discontinued the financial help. Beeler’s life became more difficult as a result. The human rights court was then approached. The government argued in court that this is not gender discrimination but rather a law based on social reality.

At the same time, Switzerland has previously been criticised for lagging behind other European countries in providing equal status and rights to women, particularly in pay equality. It took a Swiss High Court decision in 1990 to grant women equal voting rights in local elections.
