A supermarket retailer has been ordered to pay a lady with an intellectual disability €15,000 in compensation

A supermarket retailer has been ordered to pay a customer with an intellectual disability €15,000 in compensation after a security guard misidentified the lady as a shoplifter and prevented her from entering the store.

In a decision before the Workplace Relations Commission (WRC), adjudicator Shay Henry determined that the lady was denied service because of her disability and that the unnamed retailer discriminated against her under the Equal Status Act.

The woman was denied access to the retailer’s grocery store on November 18, 2021.

Mr. Henry indicated in his findings that he fully accepted that the refusal to allow the woman entry to the store was based on mistaken identity. Mr. Henry stated that the retailer’s admission of mistaken identity was not revealed to the woman until just before the hearing and that the retailer never apologised to her.
