Accused Individuals Cannot Be Denied Refugee Status, Says Justice Minister
Dublin: Justice Minister Jim O’Callaghan has stated that suspects facing criminal charges cannot be barred from seeking refugee status in Ireland. While individuals convicted of crimes can be excluded from international protection, there is no legal provision to prevent accused persons from applying for refugee status, the minister clarified.
The minister’s remarks follow the murder of Quham Babatunde on South Anne Street in Dublin on February 15. Four suspects have been remanded in custody in connection with the killing. Babatunde, a rape suspect in Italy, was deported to his home country of Nigeria before later arriving in Ireland, where he applied for international protection.
No Legal Framework to Block Accused Individuals
Minister O’Callaghan emphasised that while the government and Gardaí conduct background checks on all refugees entering the country, existing laws only allow authorities to exclude those with criminal convictions. However, individuals facing charges without a final conviction cannot be denied entry under current legislation.
“There is a clear legal provision to exclude individuals with criminal convictions from seeking international protection. However, there is no legal mechanism to bar those who have not yet been convicted or whose cases are still pending,” the minister said.
