Persecution: Court order ban, from setting foot in Ireland for 10 years 

Dublin: Karthikeya Gupta, a 22-year-old man from Lucan, received a suspended sentence for sexually harassing a young woman at a concert in Marlay Park. Judge Martin Nolan, while acknowledging the gravity of sexual assaults, emphasised that Gupta’s actions were not intentional deception. Despite the impact on the victim, who expressed fear and trauma in court, the judge suspended a 21-month prison sentence and issued a 10-year ban on Gupta’s presence in Ireland.

Highlighting Gupta’s lack of prior convictions, Judge Nolan suggested a €2,500 compensation offer to the victim, proposing charity if she declined. The victim had previously rejected this offer. The court learned that the traumatised woman now fears enjoying music and avoids any association with the incident, making even leaving her house a daunting task.

During the concert, the assailant repeatedly touched the woman inappropriately, leading to his identification and subsequent removal by a security guard. Gupta, arrested and initially claiming it was a mistake, later explained that alcohol consumption on the incident day, his first time, was the reason behind the behavior. Despite spending time in custody, he was granted bail and subsequently ordered to leave the country within two weeks. The victim expressed ongoing fear, not only of the assailant’s release but even at the mention of a music program. The incident has left a lasting impact on her, shattering the joy she sought at the concert.
