The court has granted mercy to an Indian healthcare worker who sexually assaulted a teenage girl and a young woman
Sligo: The court has granted mercy to an Indian healthcare worker who sexually assaulted a teenage girl and a young woman while collecting blood samples in the hospital’s emergency room. The court accepted his emotional remorse and excused him from prison. Eldhose Yohanna (39), a Drumcliff Milltown resident, was spared the penalty for sexual assault. Although he was sentenced to three years in prison, the court awarded him a reduced sentence under tight conditions.
Judge Johnson had requested reports from the probation service and counselling, taking into account the danger of re-offending. He also ordered the victims to pay €10,500 as compensation. The court recommended that €8,000 of the award be given to the adolescent.
The verdict states that he must not commit another crime for the following seven years and remain on probation for 18 months. In addition, the court ordered him to enroll in sexual offender therapy.
The first incident related to the case took place at the Regional Hospital in Mullingar, Westmeath. Yohannan was a trained medical professional who worked as a phlebotomist.
The charges against him included touching the girl’s bare breasts and vagina during the examination, which Mullingar Circuit Criminal Court Judge Keenan Johnson observed was an invasion of privacy and an attack on physical integrity.
The court was moved to tears.
The accused apologised in court while crying. He pleaded that he was the family’s lone earner. He also told the court that he would pay reparations. He persuaded the court that his wife, a member of a rural family, had no one to support her. His counsel informed the court that the accused will lose his career and would be placed on the sex offenders’ register, allowing him to do whatever the court directed.
Teenage girl’s mother files complaint in rape case
The 15-year-old girl came to the ED with her mother on August 8, 2022, for a check-up following a breast infection. The teenager was first seen by a triage nurse. She then went to Yohannan with her mother. He asked her mother to wait in the waiting area to take the girl’s blood. The child was then taken to another room.
After making the girl lie down on the bed, he took blood from her arm. In the meantime, he asked the girl if she had a lump in her breast. After she said yes, he lifted her top and ‘examined her breasts. The girl thought he was a doctor. After this, the accused went out and returned with his gloves off. Thinking that the examination was over, he asked the girl to lie down again. He lifted her clothes and squeezed both her breasts and asked if she felt any pain. When the girl replied yes, he told her that there was nothing wrong.
The girl who came out of the room was really upset. The daughter informed her mother about the incident and who was looking for her. They then complained to the management. The manager scolded Yohannan, questioning why he did things like that and reminding him that his duty was merely to test blood. He was fired from his job the same day. He told the court and her mother that he was trying to help.
Torture also occurred to a woman with a stomach ache.
The accused harassed a young woman who arrived at the department with a stomach ache. He brought her to his room and asked for her phone number while attempting to bring his legs close to her body. He put his finger into her vagina through her clothes. The attempt lasted for around seconds. The incident greatly traumatised the young woman, who was terrified to go to the hospital and see doctors. The young woman informed the court that she was living the life of blame. The court said that the lady did the right thing and nothing wrong. Johnson said that they had created ways and means to prevent her from becoming a victim again.
Yohannan, who qualified in India, had previously worked as an ambulance nurse in Kuwait. He was not registered in Ireland. He got married in 2018. He later came to Ireland and got a job through an agency in January 2022.
