The High Court bans a father’s wish to take his daughter back to her native land

Dublin: The High Court has blocked a father’s wish to take his daughter back to his place from Ireland. The court stated that the father has no right to demand the child’s return. The court said that the position of the child and the mother is of great importance in this regard.

The court denied the father’s request to return his daughter to the Eastern European country. Justice Mary Rose Gearty rejected the application under the Hague Convention on Child Abduction.

The judge observed that he had consented to come to Ireland. In 2021, the father, mother, and daughter arrived in Ireland. The father returned to his native land two months after arriving here, but the mother and daughter did not. My daughter was also enrolled at the next school. My daughter also liked this place. The child also told the court that she did not want to return home with his father.

The mother informed the court that she had come to look for work. The father argued that she did not support the decision to come here. But the judge judged the statement of the father to be unreliable. The court pointed out that the return ticket was not booked.

The court considered that the fact that the family had a going-away party in their own country and the daughter’s admission to the primary school here refuted the father’s argument. He found the house when he came here. That house is home to his wife and daughter. Therefore, it cannot be said that the daughter has been detained illegally, the judge said.
