Ireland Emerges Victorious in Ongoing Legal Clash with Apple as European Supreme Court Orders Case Review

Dublin: In the persistent legal tussle between Ireland and Apple, the scales tip once again in favour of Ireland. The European Supreme Court has mandated a reevaluation of the case subsequent to an EU tribunal’s ruling that favored Apple in its appeal against the 13 billion euro tax decision imposed by Ireland.

This tax dispute with Apple is a facet of the EU antitrust chief Margrethe Vestager’s campaign to scrutinise agreements between multinational corporations and EU member states.

In 2020, Apple sought refuge from the obligation to pay €13 billion in taxes to Ireland by approaching the General Court of the European Union. The court sided with Apple, asserting that regulators failed to meet the legal threshold to demonstrate that Apple had enjoyed an unfair advantage. The Court’s current finding is that there was an error in that judgement.
